Privacy Policy

1. Introduction

This Privacy Policy explains how Noteworthy Lab LLC ("Noteworthy Lab," "we," "us," or "our") collects, uses, and shares personal information when you visit noteworthylab.com (the "Site"), contact us, subscribe to our newsletter, or otherwise interact with us.

This policy covers the personal information we handle as a business in connection with our website, marketing, and communications. It does not cover personal information we process on behalf of our clients as part of delivering services. That information is governed by our agreements with those clients (see Section 12).

By using the Site, you agree to the practices described in this policy. If you do not agree, please do not use the Site.

2. Information We Collect

Information you provide to us. We collect personal information you choose to give us, such as when you complete a contact form, request information, subscribe to our newsletter, book a call, or email us. This may include your name, email address, organization or employer, role or title, phone number, and the contents of any message you send us.

Information collected automatically. When you visit the Site, limited technical information is collected automatically:

  • Our hosting provider, Webflow, may log standard server information such as your IP address, browser type, device and operating system, referring pages, the pages you view, and the dates and times of your visits. We use this to operate, maintain, and secure the Site.
  • We use Fathom Analytics, a privacy-focused, cookieless analytics service, to understand how the Site is used. Fathom does not use cookies and is designed not to collect or store personal information such as your IP address. It provides us only with anonymized, aggregate statistics about Site usage, and it does not track you across other websites. For more information, see Fathom Analytics' privacy policy.

Information from third parties. If you interact with us through third-party platforms such as our Substack newsletter or our YouTube channel, those platforms may share limited information with us in accordance with their own policies and your settings (for example, subscriber email addresses or aggregate engagement data).

3. Cookies and Similar Technologies

Because our analytics provider, Fathom Analytics, is cookieless, we do not use cookies or similar technologies for analytics or advertising. Our hosting provider, Webflow, sets only the limited, strictly necessary cookies required for the Site to function properly. We do not set any non-essential cookies, and we do not use a cookie consent banner because none is required for the cookies we use.

You can control cookies through your browser settings. Disabling strictly necessary cookies may affect how the Site functions.

4. How We Use Your Information

We use personal information to:

  • Respond to your inquiries and communicate with you
  • Provide, operate, maintain, and improve the Site
  • Send our newsletter and other communications you have requested, and let you opt out at any time
  • Understand how visitors use the Site so we can improve our content and services
  • Protect the security and integrity of the Site and our business
  • Comply with legal obligations and enforce our terms
  • We may use information to send marketing communications about our services. Where required, we will obtain your consent and always provide a way to unsubscribe.

5. How We Share Your Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not use advertising or social media tracking pixels (such as Meta or LinkedIn) on the Site.

We share personal information only in the following circumstances:

  • Service providers. With vendors who perform services on our behalf, such as website hosting, email delivery, newsletter distribution, scheduling, and analytics. These providers are permitted to use the information only to provide services to us.
  • Legal and safety. When we believe disclosure is necessary to comply with applicable law, respond to lawful requests, protect our rights, or protect the safety of any person.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, in which case personal information may be transferred as part of that transaction.
  • With your direction or consent. When you ask us to share your information or otherwise consent to the sharing.

6. Third-Party Services and Links

We rely on third-party platforms to operate parts of our business. Their handling of your information is governed by their own privacy policies, not this one. These currently include:

  • Webflow — website hosting and forms
  • Fathom Analytics — privacy-focused, cookieless website analytics
  • Substack — newsletter (opsandoutcomes.substack.com)
  • YouTube / Google — video channel (@OpsandOutcomes)
  • Google Workspace — email communications
  • Cal.com — scheduling tool

The Site may also contain links to third-party websites. We are not responsible for the privacy practices of those sites, and we encourage you to review their policies.

7. Data Retention

We keep personal information only for as long as needed for the purposes described in this policy, unless a longer period is required or permitted by law. For example, we retain inquiry and contact information for 24 months after our last interaction, and newsletter subscription information until you unsubscribe.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information. We will honor applicable rights and will not discriminate against you for exercising them.

California residents (CCPA/CPRA). Subject to applicable law, California residents may have the right to:

  • Know and access the categories and specific pieces of personal information we have collected
  • Request correction of inaccurate personal information
  • Request deletion of personal information
  • Opt out of the sale or sharing of personal information (note: we do not sell or share personal information as those terms are defined)
  • Be free from discrimination for exercising these rights

You may also designate an authorized agent to make a request on your behalf.

Visitors outside the United States. Noteworthy Lab is a United States–based company, and our Site and services are directed to organizations and individuals in the United States. We do not target or knowingly offer goods or services to individuals in the European Economic Area or the United Kingdom, and we do not monitor their behavior. As a result, we do not consider the EU or UK GDPR to apply to our processing. If you are located outside the United States and choose to contact us or use the Site, please see Section 13 regarding the transfer of your information to the United States.

How to exercise your rights. To make a request, contact us at noelia@noteworthylab.com. We may need to verify your identity before responding. We will respond within the timeframe required by applicable law.

10. Children's Privacy

The Site is intended for businesses and professionals and is not directed to children. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us and we will take appropriate steps to delete it.

11. Marketing Communications

If you receive our newsletter or other marketing emails, you can unsubscribe at any time using the link in the message or by contacting us. We will still send you non-marketing communications related to your inquiries or our business relationship.

12. Information We Process on Behalf of Clients

In delivering services, Noteworthy Lab may have access to or process personal information contained in our clients' systems and data (for example, a client's donor, member, or contact records). When we do, we act as a service provider or processor on the client's instructions. That processing is governed by our agreement with the client, not by this Privacy Policy. Individuals with questions about how a particular organization handles their information should contact that organization directly.

13. International Visitors

We are based in the United States, and the Site is operated from the United States. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Site after an update means you accept the revised policy.
